OVERVIEW

This website is operated by M Hernandez Enterprises, LLC, doing business under the registered assumed name (DBA) TrueArc. Throughout these Terms, “TrueArc,” “we,” “us,” and “our” refer to M Hernandez Enterprises, LLC, doing business as TrueArc. “You” and “your” refer to the customer or user of the Services.

These Terms of Service (“Terms”) govern your access to and use of TrueArcWeld.com, including its content, features, products, checkout, customer accounts, and related services (collectively, the “Services”).

By accessing the Site, creating an account, submitting information, or purchasing a product, you agree to these Terms and the policies incorporated into them. If you purchase on behalf of a business or other entity, you represent that you have authority to accept these Terms on its behalf.

If you do not agree to these Terms, do not access or use the Services.

ELIGIBILITY

You must be legally capable of entering into a binding agreement in your jurisdiction to purchase through the Site.

If you permit a minor to use the Services, you are responsible for the minor’s activity and purchases.

STORE PLATFORM

Our store is hosted by Shopify. Shopify provides the ecommerce platform used to display products, process transactions, manage accounts, and provide portions of the checkout experience.

PRODUCT INFORMATION AND AVAILABILITY

We make reasonable efforts to accurately describe and display our products. Product images, colors, finishes, viewing-window appearances, and other visual details may vary because of lighting, photography, manufacturing variation, and the display settings of your device.

Product descriptions, pricing, availability, specifications, packaging, and promotions may be corrected or changed without notice.

Products may have limited quantities. We may discontinue products or limit sales by customer, household, address, region, or order quantity.

An item appearing on the Site does not guarantee that it is currently available.

WELDING SAFETY AND PRODUCT COMPATIBILITY

Welding is hazardous and requires appropriate training, judgment, protective equipment, ventilation, and compliance with applicable safety requirements.

TrueArc products do not replace required personal protective equipment, safe work practices, professional training, or compliance with applicable laws, regulations, employer requirements, and safety standards.

Customers are responsible for:

  • Selecting the proper product, lens size, shade, and settings for their application

  • Confirming compatibility with their hood, equipment, welding process, and working conditions

  • Inspecting products before each use

  • Following all product instructions and applicable safety requirements

  • Discontinuing use of any product that is damaged, modified, malfunctioning, or unsuitable for the application

For TIG welding, TrueArc only recommends the VPro Series. TrueArc does not recommend HD, Blue, Gold, XL, or other non-VPro lens lines for TIG welding.

ORDERS AND ORDER ACCEPTANCE

Submitting an order does not guarantee acceptance. We may refuse, limit, place on hold, or cancel an order for reasons including:

  • Product unavailability

  • Pricing, description, or inventory errors

  • Suspected fraud, abuse, unauthorized payment, or resale activity

  • Shipping restrictions

  • Violation of these Terms

  • Inability to verify order or payment information

If we cancel an order after payment has been authorized or collected, we will void the authorization or issue an appropriate refund.

PRICES, PAYMENTS, AND TAXES

Prices are displayed in U.S. dollars unless otherwise stated.

Applicable shipping charges and taxes are calculated during checkout. Prices and promotions may change without notice, but changes will not affect an order already accepted except when necessary to correct an obvious error.

Payments are processed by Shopify and participating payment providers. You agree to provide accurate billing and payment information and confirm that you are authorized to use the payment method submitted.

PROMOTIONS AND DISCOUNT CODES

Promotions and discount codes:

  • Are subject to their stated eligibility requirements

  • May be limited to specific products, customers, dates, quantities, or sales channels

  • Have no cash value

  • Cannot be sold, transferred, reproduced, or used fraudulently

  • Cannot be combined unless expressly permitted

  • May be modified or ended where permitted by law

The XL lens and Vintage Series hood promotion requires the qualifying products to be included in the same order. The eligible hood receives the advertised promotional discount while the qualifying XL lens remains at its applicable price.

If part of a bundle or promotional purchase is returned, the refund may be adjusted to account for the items kept and any promotional eligibility that is lost.

SHIPPING AND DELIVERY

TrueArc currently ships within the United States.

Shipping times are estimates and are not guaranteed. Delivery may be affected by carrier delays, weather, address errors, holidays, order verification, inventory availability, or other circumstances beyond our reasonable control.

Customers are responsible for providing a complete and accurate delivery address. Contact us immediately if an address correction is needed. We cannot guarantee that an address can be changed after fulfillment begins.

RETURNS, REFUNDS, AND LIMITED WARRANTY

Returns, refunds, damaged shipments, promotional returns, and the one-year limited warranty are governed by our Return and Refund Policy:

The express one-year limited warranty described in that policy is not eliminated by any general Site or Service disclaimer in these Terms.

CUSTOMER ACCOUNTS

You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.

Provide accurate and current account information. Notify us promptly if you believe your account has been accessed without authorization.

We may suspend or terminate accounts involved in fraud, abuse, resale activity, security threats, or violations of these Terms.

ELECTRONIC COMMUNICATIONS

By using the Services, you agree that we may send transactional electronic communications concerning orders, payments, shipping, accounts, returns, warranties, security, and customer service.

Marketing communications are subject to your preferences. You can unsubscribe from promotional emails using the unsubscribe link included in those messages.

INTELLECTUAL PROPERTY

The Site and its content—including the TrueArc name, logos, trademarks, product names, designs, photographs, graphics, videos, text, and other materials—are owned by or licensed to TrueArc and protected by applicable intellectual-property laws.

You may use the Site only for personal, lawful shopping and informational purposes. You may not reproduce, modify, distribute, sell, scrape, republish, or commercially exploit Site content without prior written authorization.

REVIEWS, FEEDBACK, AND USER CONTENT

If you submit a review, photograph, video, testimonial, comment, suggestion, or other content, you represent that:

  • You own or have permission to submit it

  • It is accurate and based on your genuine experience where applicable

  • It does not violate another party’s intellectual-property, privacy, publicity, or other rights

  • It is not unlawful, defamatory, threatening, fraudulent, obscene, or misleading

  • It does not contain malicious code or unauthorized advertising

You retain ownership of your content but grant TrueArc a non-exclusive, worldwide, royalty-free license to use, reproduce, display, adapt, and distribute it for operating, improving, and promoting TrueArc and its products.

We may moderate or remove content that violates these Terms.

PROHIBITED USES

You may not use the Services to:

  • Violate any law or the rights of another person

  • Commit fraud or submit false or misleading information

  • Infringe intellectual-property, privacy, or publicity rights

  • Transmit malware, harmful code, or security threats

  • Scrape, crawl, probe, disrupt, or circumvent Site security

  • Collect information about others without authorization

  • Spam, phish, impersonate another person, or interfere with the Services

  • Purchase products for unauthorized resale

  • Use products or information for an unlawful or intentionally unsafe purpose

The Services may contain third-party applications, payment options, links, or tools. Third-party services are governed by their own terms and policies.

SERVICE AVAILABILITY

We do not guarantee that the Site or Services will always be uninterrupted, secure, error-free, or available.

We may update, suspend, restrict, or discontinue any portion of the Services where reasonably necessary.

DISCLAIMER

Except for the express one-year limited warranty stated in our Return and Refund Policy, and to the fullest extent permitted by law, the Site and Services are provided on an “as available” basis.

Nothing in these Terms excludes or limits warranties, remedies, or consumer rights that cannot lawfully be excluded or limited.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, TrueArc and its owners, officers, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, punitive, or consequential damages arising from the use of the Site or Services.

To the fullest extent permitted by law, TrueArc’s total liability for a claim relating to a product purchase will not exceed the amount paid for the product giving rise to the claim.

These limitations do not apply where liability cannot lawfully be excluded or limited.

INDEMNIFICATION

To the fullest extent permitted by law, you agree to indemnify and hold TrueArc harmless from third-party claims, losses, or expenses arising from your unlawful use of the Services, violation of these Terms, or infringement of another party’s rights.

SEVERABILITY

If any provision of these Terms is held unlawful or unenforceable, that provision will be enforced to the maximum extent permitted or severed, and the remaining provisions will remain effective.

NO WAIVER

Failure to enforce a provision of these Terms does not waive our right to enforce that provision later.

ENTIRE AGREEMENT

These Terms and the policies incorporated by reference constitute the agreement between you and TrueArc concerning the Services and supersede prior communications relating to the same subject matter.

GOVERNING LAW

These Terms are governed by the laws of the State of Texas and applicable federal law, without regard to conflict-of-law principles.

To the extent permitted by law, disputes will be brought in the state courts located in Hidalgo County, Texas, or the federal courts serving Hidalgo County, Texas.

CHANGES TO THESE TERMS

We may update these Terms to reflect changes in our practices, products, Services, or legal obligations.

Updated Terms will be posted on the Site with a revised “Last updated” date. Continued use of the Services after an update constitutes acceptance of the revised Terms to the extent permitted by law.
